Here are a few tips to help make the process go as smoothly as possible:
- Agree a workable way to communicate: Discuss with your own lawyer how instructions, decisions and updates should be shared. Direct contact may not suit every situation. A clear communication arrangement can help prevent misunderstandings.
- Get independent legal advice early: Your lawyer can explain your rights, responsibilities and who needs to authorise the sale. A salesperson can help with the appraisal and campaign, but does not replace your own legal adviser.
- Allow space for the personal side: A home can hold years of memories, and selling during a separation can be difficult. Ask for a clear explanation of each decision and the time available to consider it with your advisers.
- Create a practical sale plan: Once the necessary instructions are agreed, set out pricing, preparation, access, marketing costs and timing with your salesperson and advisers. Confirm how offers and any proposed changes to the plan will be communicated.
- Consider offers with your advisers: Price, conditions and settlement can all affect a proposed sale. Take advice before agreeing to terms, and have any arrangements about the sale and proceeds documented appropriately.
